Terms of Service

These Terms apply to heytaby.com, Taby Digital, Taby Physical, downloads, updates, activation, order status pages, Discord app features, linked roles, support, and related Hey Taby services. In these Terms, "Taby", "Hey Taby", "we", "us", and "our" refer to the maker and operator of those services.

Contact: support@heytaby.com. If a checkout receipt, invoice, app store, or payment processor identifies a specific seller or merchant of record, that seller is responsible for the sale shown on that receipt.

Taby is a local-first desktop productivity app with tasks, notes, habits, focus timers, activity insights, and local AI features. Taby Physical adds a small desk companion screen that connects to the desktop app by USB-C or Bluetooth.

You are responsible for using Taby safely, keeping your device and operating system up to date, and backing up any data you care about. Taby is not designed for emergency, medical, legal, financial, safety-critical, or other high-risk use.

Prices, currencies, taxes, shipping availability, and delivery estimates may vary by region and can change before purchase. Payments are processed by Stripe or another payment provider shown during checkout.

Taby Physical may be sold as a preorder or beta hardware product. Shipping dates are estimates, not guaranteed delivery dates, because hardware assembly, customs, carriers, battery rules, and address confirmation can affect timing.

If you change your mind before a Taby Physical unit ships, you can request a full refund. After delivery, refunds are handled case by case for hardware defects or issues that prevent normal use. Digital purchases and app access issues are reviewed case by case, and mandatory consumer rights still apply.

Some Taby features are beta, experimental, or marked as coming soon. This includes local AI, Linux support, voice or talk features, automation features, and any future hosted AI option. Beta features may be incomplete, inaccurate, interrupted, changed, or removed.

AI output can be wrong, incomplete, or unsuitable for your situation. You are responsible for reviewing Taby's suggestions before relying on them or taking action.

Use Taby Physical indoors, with suitable USB-C power, and away from liquids, heat, and conditions that could damage electronics. Taby includes small parts and magnets; keep it away from small children, pets, magnetic storage media, implanted medical devices, and anything that may be affected by magnets.

DIY files, open-source examples, firmware experiments, 3D printing, soldering, electronics modifications, and unofficial builds are provided for learning and experimentation. You are responsible for your own tools, materials, safety precautions, and results.

Hey Taby may provide a Discord app, interactions endpoint, linked role verification page, community server, or other community features. These features are provided for support, community access, product updates, and lightweight account or purchase verification.

Discord features also depend on Discord's own service, permissions, OAuth screens, server settings, and terms. A linked role or Discord connection is not a guarantee of uninterrupted access, support priority, entitlement, or identity verification.

The Taby desktop app is designed to keep tasks, notes, habits, timers, activity history, and local AI context on your computer unless you choose to use a feature that sends data elsewhere. You keep ownership of your content.

You grant us the limited rights needed to operate services you request, such as processing a checkout, sending an activation email, answering a support request, verifying a Discord-linked role, or delivering an optional hosted feature you enable.

• Do not misuse Taby, the website, downloads, Discord app, APIs, or support channels.
• Do not attempt to bypass payment, activation, rate limits, security checks, Discord verification, or access controls.
• Do not upload, send, automate, or share unlawful, harmful, abusive, infringing, or deceptive content through Hey Taby services.
• Do not reverse engineer, modify, resell, or redistribute paid Taby software except where applicable law expressly allows it.

Taby software, hardware designs, website content, branding, animations, product copy, and related materials are owned by Hey Taby or its licensors, except for materials explicitly published under a separate open-source license.

Open-source or DIY materials are governed by their own licenses. Paid Taby software and services are licensed, not sold, unless a separate agreement says otherwise.

Taby may use third-party services for payments, hosting, analytics, email delivery, activation, downloads, Discord features, shipping, and support. Those services are governed by their own terms and privacy notices.

We are not responsible for third-party outages, policy changes, payment declines, carrier delays, Discord permission changes, or other events outside our reasonable control.

To the maximum extent permitted by law, Taby and related services are provided "as is" and "as available" without warranties that they will be uninterrupted, error-free, secure, compatible with every device, or suitable for every purpose.

Nothing in these Terms excludes warranties, refund rights, remedies, or liabilities that cannot be excluded under applicable consumer protection law.

To the maximum extent permitted by law, Hey Taby will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost data; loss of goodwill; device issues; AI mistakes; or service interruptions.

To the maximum extent permitted by law, our total liability for a claim related to Taby is limited to the amount you paid for the affected product or service in the 12 months before the event giving rise to the claim.

We may update Taby, change features, fix bugs, add limits, suspend abusive access, or stop providing a service where needed for security, operations, legal compliance, or product direction.

We may update these Terms from time to time. The effective date above shows when this version took effect. Continued use after an update means you accept the updated Terms.

These Terms are governed by the laws applicable to the seller or service operator identified for your transaction, without regard to conflict-of-law rules. If mandatory consumer laws in your country give you stronger rights, those rights still apply.

If part of these Terms is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and Hey Taby for the services they cover, unless a separate written agreement applies.
